Overview of the Sprint Referral Rewards Program
  1. The Sprint Referral Rewards Program (the “Program”) is a loyalty program sponsored by Sprint through which individuals can earn a $25 Visa® debit card for each person they refer to Sprint as set forth below (up to 12 referrals per year).
  2. The referred friends will also earn a $25 Visa® debit card when they activate their Nextel or Sprint service as set forth below.
Eligibility
  1. The Program is open only to U.S. residents who are eighteen (18) years of age or older and are Sprint customers in good standing. A completed referral must be received by Sprint within 15 days of the referred person's activation to receive the offer. A customer may not refer himself/herself. Accounts are limited to 12 referrals in a calendar year. Referred person's phone activation must occur at least 24 hours after referring person's phone activation. A referring purchaser and a referred purchaser on a company sponsored business account is not eligible for the offer. Debit cards are mailed to the party responsible for payment. Both referring purchaser and referred purchaser must have an active account for 30 consecutive days or longer before the reward can be applied. Sprint Nextel employees, Affiliate employees and third party employees are not eligible. Please allow six to eight weeks for processing. Sprint reserves the right to alter or discontinue this program at any time without notice.
  2. Participation in the Program constitutes the Participant's full and unconditional agreement to these Terms and Conditions.
Program Period
The customer referral program ends on December 31, 2008. Referral rewards may be applied to the first 12 qualified new accounts the customer refers by December 31, 2008, and whose accounts are activated by that date.
Participating in the Program
  1. Visit participating Nextel and Sprint retail stores, or visit sprint.com/nextelreferral.
  2. GUIDELINES IF NEW CUSTOMER IS REFERRED TO SPRINT OR NEXTEL SERVICE: Sprint and Nextel customers may encourage their friends to purchase Sprint or Nextel phones and service from sprint.com, or from participating Sprint or Nextel retail stores. If the referred customer wishes to purchase Nextel service via Sprint.com and their referring friend is a Nextel customer, they may input the Nextel Direct Connect® number of their referring friend into the “Promotional Code” box at the bottom of the shopping cart in order to submit a referral at the time of sale. If the referred friend does not provide the information at point of sale, he/she may dial #REF from the new Sprint or Nextel phone once service is activated. The referred customer must dial #REF from on his/her new Sprint or Nextel handset within 15 days of activation and follow the voice prompts to enter his/her Sprint or Nextel phone number, and the referring party's Sprint or Nextel phone/Direct Connect® number. Both the referred and referring parties will receive their rewards in 6 - 8 weeks. Note: Due to Sprint's privacy policy, Sprint cannot provide information to the referring customer regarding the status of the referred friend's account (e.g., whether an invoice has been paid). To receive the referral rewards, accounts must be activated by 11:59 p.m. Eastern Time on December 31, 2008.
  3. New activation, one- or two-year Service Agreement and credit approval are required. A $200 early termination fee will apply after a 30-day trial period (conditions apply).
  4. Corporate Individual-liable and Government Individual-liable accounts may participate in the referral program. Business-liable accounts are not eligible for the program except iDEN to iDEN small business referrals (up to 124 units).

  6. Sprint reserves the right to require proof, including, but not limited to, a receipt, that Sprint or Nextel service was activated in accordance with these Terms and Conditions.
Modifications and Termination of the Program
  1. Sprint reserves the right to modify any of the terms and conditions set forth herein - including, but not limited to, the methods through which customers may earn rewards and the amount of rewards that can be earned by referring friends - at any time, with or without notice, even though these changes may affect a customer's ability to receive a reward card or service credit.
  2. A customer's participation in the Program constitutes the customer's acceptance of any changes to these Terms and Conditions. Customers are responsible for remaining knowledgeable as to any changes that Sprint may make to these Terms and Conditions. The most current version of these Terms and Conditions will be available at sprint.com/nextelreferral and will supersede all previous versions of these Terms and Conditions.

Limitations of Liability
  1. By participating in the Program, Customer acknowledges that technical processing and transmission of information on the Sprint Web site may involve transmissions over various networks and changes to conform and adapt to technical requirements of connecting networks or devices. Sprint is not responsible for: (a) incorrect or inaccurate transcription of information; (b) problems related to any of the equipment or programming associated with the Program or utilized by the Participant; (c) any human error or printing error; (d) any interruption, deletion, omission, defect, or line failure of any telephone network or electronic transmission; (e) problems relating to computer equipment, software, inability to access the Sprint Web site; or (f) any other technical or non-technical error or malfunction.
  2. By participating in the Program, each Customer accepts all responsibility for, and hereby indemnifies and holds harmless Sprint, each of its related companies, and each such company's respective officers, directors, employees, shareholders, agents, and successors, and assigns (the “Released Parties”), from and against any claims that may arise from actions taken by such Participant.
  3. UNDER NO CIRCUMSTANCES, INCLUDING, BUT NOT LIMITED TO, NEGLIGENCE, SHALL THE RELEASED PARTIES BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES ARISING OUT OF THE PROGRAM, EVEN IF ANY OR ALL OF THE RELEASED PARTIES HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, THEREFORE SUCH EXCLUSIONS MAY NOT APPLY TO YOU. IF A PARTICIPANT PROVES THAT SPRINT HAS IMPROPERLY DENIED THAT PARTICIPANT ANY AIRTIME, LIABILITY WILL BE LIMITED TO THE EQUIVALENT AMOUNT OF AIRTIME. BY PARTICIPATING IN THE PROGRAM, A PARTICIPANT WAIVES ANY AND ALL RIGHTS TO BRING ANY CLAIM OR ACTION RELATED TO SUCH MATTERS IN ANY FORUM BEYOND ONE (1) YEAR AFTER THE FIRST OCCURRENCE OF THE KIND OF ACT, EVENT, CONDITION OR OMISSION UPON WHICH THE CLAIM OR ACTION IS BASED.
  4. Except where prohibited, Customer agrees that: (a) any and all disputes, claims, and causes of action arising out of or connected with the Program shall be resolved individually without resort to any form of class action and exclusively by arbitration under the Commercial Arbitration Rules of the American Arbitration Association; (b) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred (i.e.,only costs associated with participating in the Program), but shall not include attorneys' fees under any circumstances; and (c) Member hereby waives all rights to claim punitive, incidental, and consequential damages.
  5. If any provision of these Terms and Conditions is found to be invalid or unenforceable by a court of competent jurisdiction, such provision shall be severed from the remainder of these Terms and Conditions, which will otherwise remain in full force and effect.
